A case against Trinity College’s overnight guest policy was brought to the Residential Tenancy Board by then-student union president László Molnárfi in November 2024. The Residential Tenancy Board (RTB) ruled that Trinity College’s overnight guest policy was in violation of the peaceful occupation clause of the Residential Tenancies Act 2004. The policy in question involved requirements to identify guests, imposition of curfews and cut-off times for guest check-ins, amongst other practices.
After several appeals by the University, the RTB delivered its final ruling the policy is impermissible in its current form, but held that the college still has the right to enforce some guest regulations.
The University has confirmed that while students in accommodation still have to register overnight guests, they may now do this online at any time of the day or night without a cut-off time of as applied in the past.
This is the first instance that the peaceful occupation clause was applied in a case involving student licensees.
