WRC finds hotel discriminated against man who resigned due to HIV status

The Workplace Relations Commission (WRC) has found a hotel discriminated against a man who was HIV positive where it failed to make reasonable adjustments to his work schedule.

The complainant began working in a hotel in February 2018 and resigned two days later after his request for shorter working hours was denied. The complainant had been required to work breakfast, lunch and dinner shifts which he found tiring and which made it difficult for him to take his medication correctly. The complainant disclosed his HIV status to his employer who did not offer any reasonable adjustments to his work schedule.

The WRC found that once the employer was made aware of the reason for the complainant’s resignation, the employer was then obliged to make further enquiries into the extent of the disability and establish whether it might be reasonably accommodated. In ordering the hotel to pay the complainant €3000, the WRC was satisfied that the employee had been discriminated against and that the employer had failed to make proper accommodation for the disability.
