The class will look at the meaning of the best interests concept in international child rights law particularly as elaborated on by the Committee on the Rights of the Child, the ECtHR and the CJEU, focusing on the meaning of the term ‘best interests’ and the nature of the legal obligation (encompassing personal and material scope, the weight to be allocated to the child’s best interests and the conduct of the assessment).
It will also focus on the application of the concept to the asylum context and practical issues such as age assessments, interviews, child trafficking victims (in particular the difficulties they present in terms of taking instructions) and the different models of representation – best interests advocacy and ethics.
