This Irish Refugee Council class will look at the general principles governing the right to “effective judicial protection” guaranteed under EU law and the general principles governing the right to an effective remedy as specifically guaranteed under Art 47 of the EU Charter of Fundamental Rights (CFR) and other instruments.
It will also examine the particular application of those principles to asylum cases including Article 39 of the Procedures Directive 2005/85 ‘The right to an effective remedy’ and give particular consideration to Case C‑175/11, H.I.D.B.A v Refugee Applications Commissioner, Refugee Appeals Tribunal, Minister for Justice, Equality and Law Reform, Ireland.
