This course considers the issue of mental incapacity in the context of community care provision by Health and Social Care Trusts. It will address the legal issues involved when a person in need of community care services lacks the necessary mental capacity to make decisions on her/his own behalf.
The course will look at decision-making in relation to the person’s finances and will examine the role of the Office of Care and Protection. It will also address decision making in relation to health and social care services and examine the legal perspective on disputes between care professional and carers. This course will also look at relevant case law and DHSSPS Guidance.

New/experienced advisers, legal practitioners, health and social care trust staff and others who work with older people, people with disabilities and carers.
